"Buy 2, get 1 free." "Share this post and win a phone." "First 50 buyers enter our raffle." In Nigeria, the moment your WhatsApp group runs a promotion with prizes, you are in regulated territory. This guide explains what the FCCPC says about sales promotions, what changed with the 2026 draft regulations, why ARCON comes up in every conversation about online ads, and how to take payment with Paystack or Flutterwave.
The short answer: a sales promotion (raffle, giveaway, prize draw, "win" campaign) in Nigeria falls under the FCCPC, which runs a registration process for it, based on the Sales Promotion Registration Regulations 2005. On 30 September 2026 the FCCPC published a draft of amended regulations, open for comments until 20 October 2026. ARCON is widely reported to require pre-approval for adverts, including on social media, but we couldn't verify that on its official site, so check it yourself before you rely on anything said about it.
Discount or sales promotion? Know which one you're running
Not every deal is a "promotion" in the regulatory sense. Posting "this blender is ₦X today" in your group is a price offer. The moment there's a prize, a draw, a contest or a "win" element, you should check the FCCPC's sales promotion rules.

What the FCCPC says about sales promotions
The Federal Competition and Consumer Protection Commission (FCCPC) states that it can "regulate any advertisement/statements directed at consumers". It also runs a process for the approval and registration of sales promotions, based on the Sales Promotion Registration Regulations 2005. The 2026 draft: what changes and when to comment
On 30 September 2026, the FCCPC published the draft "Sales Promotion (Amended) Regulations, 2026". According to the FCCPC, the draft amends the 2005 regulations and "modifies applicable fees for notifications". It is a draft, so the final text may differ.

If you run regular promotions, read the draft on the FCCPC site before the comment deadline. Small sellers rarely comment on regulations, so your view as a WhatsApp seller could actually be useful.
ARCON: why everyone mentions it, and why you should check yourself
The Advertising Regulation Council of Nigeria (ARCON) comes up in almost every discussion about online ads in Nigeria. Press reports (Techpoint, BrandCom, Mondaq) say ARCON requires prior approval of adverts, including those by influencers and on social media, and mention a federal court decision in April 2025 in ARCON's favour.
Here's the honest part: we could not open ARCON's official website to confirm any of that, and press reports also quote fees we can't verify. So treat this as a warning sign, not as a rule we can state for you:
- If you pay influencers or run formal ad campaigns, check ARCON's official rules (or ask a Nigerian lawyer) before you start.
- Don't repeat ARCON fee amounts from blogs in your group or to your clients.

Taking payment: Paystack, Flutterwave and transfers
WhatsApp's payments documentation only covers India and Brazil, so in Nigeria payment happens outside the app. Two well-known providers work in Nigeria:

Lists Nigeria among its countries, alongside Ghana, Kenya, South Africa, Uganda and Tanzania, among others.
Still common for small sellers. Confirm the money is in your account before dispatch, not just a screenshot.
A payment link has a trust advantage: the customer sees a checkout page with your business name instead of a personal account number. Paystack's support article states that its services are only for registered businesses in its countries, so check the requirements before you plan around it.

Running a prize promotion in your group: a safe sequence
